OnDuty365 Disclaimer

This disclaimer applies to your use of the OnDuty365 platform (our mobile app, web admin dashboard, and website). It operates to the maximum extent permitted by law and does not exclude, restrict, or modify any consumer guarantee, right, or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded. It should be read together with our Terms of Service and Privacy Policy.

  1. We are software, not a security service. OnDuty365 provides workforce-management software. We do not provide, supply, procure, arrange, or carry on security services or security activities, and we do not hold a security master or business licence.

  2. We are not your employer or a labour-hire provider. We do not employ, engage, on-hire, supply, direct, or pay any worker for their work. The business that engages a worker is the employer or principal and is responsible for holding all required security and labour-hire licences, for paying the worker, and for setting the terms of the work.

  3. Verification checks are point-in-time only. Where the Platform displays a verification indicator (such as a badge or status label on a worker's profile), it means that a check was run against an official government register or other authorised source at the time shown. It does not mean the licence or document is currently valid, has not changed since the check, or that the register data was accurate. Register accuracy is determined by the relevant government authority, not by OnDuty365. OnDuty365 does not warrant the ongoing currency, accuracy, or completeness of any verification result. Businesses must independently verify all worker credentials before engagement and must not rely solely on Platform verification indicators.

  4. Welfare checks and duress/SOS features are not an emergency service. They are not monitored emergency response and are not a substitute for calling 000. In an emergency, contact emergency services directly. We do not guarantee that any alert, welfare check, or duress signal will be received, monitored, or acted upon.

  5. We do not guarantee monitoring uptime or availability. Location updates, alerts, notifications, and monitoring may be delayed, incomplete, or unavailable. Do not rely on the Platform as your only means of confirming a worker's safety or location.

  6. Our AI assistant is not professional advice. AI-assisted features are informational only. They are not legal, payroll, industrial-relations, financial, medical, or emergency advice, and they may be inaccurate. Always verify before you act on them. Any consequential decision must be made by a person with appropriate authority.

  7. You are responsible for surveillance notices and consents. If you monitor personnel through the Platform, you are responsible for giving every workplace-surveillance notice and obtaining every biometric and location consent required by law (for example, the NSW Workplace Surveillance Act 2005 requirement to give at least 14 days' written notice, and the ACT Workplace Privacy Act 2011 notice and consultation requirements) before you enable those features.

  8. The AI assistant produces assistive outputs, not final decisions. Outputs of the AI assistant, including any payroll, award-rate, and pay calculations, are assistive tools to support your judgement. Every action the assistant proposes requires your explicit confirmation, which shows you the exact details (worker, dates, hours, amounts) before anything is saved. You must review those details before confirming, and before finalising any pay run or issuing any payslip. To the maximum extent permitted by law, including without limiting any non-excludable guarantee under the Australian Consumer Law, OnDuty365 is not liable for any loss, underpayment, overpayment, regulatory penalty, or other damage arising from your confirmation of an assistant output you have not adequately reviewed. The section 17 liability cap and carve-outs in the Terms of Service are unaffected by and operate alongside this item.

  9. You are responsible for your own intellectual property compliance. OnDuty365 develops the Platform independently and in good faith. We disclaim all warranties that the Platform does not infringe any third-party intellectual property right (see our Terms of Service clause 16). You are solely responsible for ensuring that your use of the Platform, and any content or data you upload through it, does not infringe any third-party patent, trademark, copyright, or other intellectual property right. If you believe OnDuty365 infringes your intellectual property, contact legal@onduty365.com with written details before initiating legal proceedings.
